Buyora – Terms and Conditions

  1. 1. Acceptance of these Terms

    1.1 These Terms and Conditions (“Terms”) govern your access to and use of the Buyora website, mobile versions, and related post-purchase support services (together, the “Service”), provided by LAGATE BUSINESS LTD, a company incorporated in Cyprus under number HE469081, with registered offices at Thessalonikis 41, Geri, 2200 Nicosia, Cyprus (“Buyora”, “we”, “us”, “our”). VAT Number: 60115895L.

    1.2 By creating an account, starting a trial, purchasing a subscription or otherwise using the Service, you confirm that you are at least 18 years old, have read these Terms, and agree to be legally bound by them. If you do not agree, you must not use the Service.

    1.3 These Terms incorporate by reference our Privacy Policy, Subscription Terms, and Money-Back Policy. In case of conflict, the order of precedence shall be:

    (i) Subscription Terms

    (ii) Money-Back Policy

    (iii) these Terms

  2. 2. Definitions

    “Active Member” – a user whose subscription is fully paid and current.

    “Qualifying Purchase” – an online transaction made using a personal payment card (Visa or Mastercard) registered in your name.

    “Claim Window” – the period beginning 15 days after the transaction date and ending 90 days after that date.

    “Content” – all data, documents, messages, or other material submitted in support of a refund claim.

  3. 3. Changes to Terms or Service

    3.1 We may amend these Terms or update the Service at any time to reflect legal, technical, or operational changes. Changes will be posted with an updated “Last updated” date. Your continued use of the Service after any changes constitutes your acceptance.

    3.2 If a change materially diminishes the Service, you may cancel and request a pro-rata refund for any unused portion of your current billing cycle.

  4. 4. The Service

    4.1 Buyora is a subscription-based post-purchase assistance platform that helps Active Members pursue refunds, chargebacks, or legal actions when online orders encounter problems.

    4.2 Depending on your subscription and the situation, our process may include:

    • contacting merchants via email, phone, or letter;
    • sending a formal notice (“mise en demeure”) by registered mail;
    • assisting in preparing chargeback requests to your bank;
    • escalating unresolved cases to partner lawyers or legal representatives.

    4.3 No guarantee of outcome. We make every effort to assist but cannot promise success. Decisions ultimately rest with the merchant, bank, or court.

  5. 5. Subscription, Fees & Free Trial

    Full commercial details, including plan types, cancellation methods, and refund eligibility, are set out in our Subscription Terms and Money-Back Policy.

    Buyora offers access to its post-purchase claim assistance service through two different subscription plans. The key features of each plan may vary, but typically include:

    • Assistance with refund claims
    • Advanced merchant dispute resolution
    • Priority claim handling
    • Full claim management
    • Dedicated customer support
    • Legal escalation support where appropriate

    A trial period is available for new users. The trial:

    • Is limited to one per person
    • Lasts 7 days
    • Requires a symbolic charge of £1 / €1 to activate

    Unless cancelled before the end of the trial, the subscription automatically renews into one of the available paid plans. The applicable plan and billing amount are clearly displayed during checkout.

    Prices and features are subject to change. We encourage you to review current offers directly on our website or during the sign-up process. Your plan may renew monthly until cancelled.

    You may cancel at any time via your account dashboard or by contacting customer service. Cancellation will take effect at the end of the current billing cycle.

    A 30-day satisfaction guarantee may apply under the conditions outlined in our Money-Back Policy.

  6. 6. Eligibility to Make a Claim

    To file a claim, you must:

    • be an Active Member at the time of submission;
    • have made a Qualifying Purchase;
    • submit your claim within the Claim Window;
    • provide full documentation, including proof of purchase, correspondence, contracts, and (where applicable) return confirmation;
    • respect the limit of one open claim per calendar week.

    We reserve the right to reject claims that are incomplete, abusive, fraudulent, out-of-window, or incompatible with card scheme rules.

  7. 7. Exclusions

    Buyora does not cover:

    • transactions via PayPal, Klarna, gift cards, cryptocurrency;
    • corporate or business card payments;
    • purchases made on behalf of another person where you are not the named buyer;
    • deposits for real estate, financial instruments, or intangible digital goods;
    • disputes already escalated to a court, card scheme, ombudsman, or regulator;
    • any unlawful, fraudulent, or prohibited activity.
  8. 8. Your Responsibilities & Code of Conduct

    You agree to:

    • provide truthful, lawful, and accurate information;
    • use the Service only for personal, non-commercial use;
    • treat our support staff courteously and respectfully.

    You agree not to:

    • use the Service for automated, excessive, or false claims;
    • scrape, reverse-engineer, or replicate the platform;
    • resell, sublicense, or misuse the Service.
  9. 9. Intellectual Property

    All content, visuals, technology, and methods used on the Buyora platform belong to us or our licensors. You are granted a non-exclusive, revocable, personal licence to use the Service, subject to these Terms.

  10. 10. Disclaimer of Warranties

    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY. WE DISCLAIM ALL WARRANTIES INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT. WE DO NOT PROVIDE LEGAL ADVICE NOR GUARANTEE ANY OUTCOME.

  11. 11. Limitation of Liability

    To the extent permitted by law, our total liability for any claim arising out of the Service will not exceed:

    • the total subscription fees paid by you in the 12 months prior to the event, or
    • €100 / £100 — whichever is greater.

    We are not liable for indirect, incidental, or consequential damages.

    These Terms do not limit liability that cannot be excluded by law, including for fraud, personal injury, or death caused by negligence, or your mandatory consumer rights.

  12. 12. Indemnity

    You agree to indemnify and hold us harmless from any loss, liability, claim or expense arising from:

    • your breach of these Terms;
    • your misuse of the Service;
    • your violation of third-party rights through Content you submit.
  13. 13. Governing Law & Dispute Resolution

    13.1 These Terms are governed by the laws of Cyprus, subject to your local consumer protections if you reside in the EU or UK.

    13.2 Before initiating formal proceedings, contact help@wearebuyora.com. We will attempt to resolve your issue informally.

    13.3 If no resolution is reached, disputes may be brought before:

    • the competent courts of Nicosia, Cyprus, or
    • your place of habitual residence if required by applicable consumer law.

    13.4 No class actions. You agree to resolve disputes with us individually. Collective, representative, or class action claims are not permitted.

  14. 14. Money-Back Guarantee

    If you cancel within 30 days of your first paid charge and meet the conditions outlined in our Money-Back Policy, we will refund 100% of that charge to your original payment method.

  15. 15. Severability & Miscellaneous

    If any provision is found invalid, the rest remain in force. Our failure to enforce any provision is not a waiver. We may assign these Terms without notice. You may not assign them. Notices sent by email or through your account dashboard are considered valid.
